CONWAY, Ark. -

A Faulkner County Circuit Court judge plans to rule this week on a motion to dismiss capital murder counts against a former emergency room doctor accused of killing two people in 2002.
Judge Charles Clawson said Tuesday he wants to review exhibits submitted by lawyers for Richard Conte, who is scheduled to go on trial May 7 for the deaths of 49-year-old Carl Elliott and 25-year-old Timothy Robertson in Conway.

Conte was charged before he was paroled from a Nevada prison where he was serving a sentence for kidnapping his ex-wife, Lark Gathright-Elliott, who was once married to Elliott.

Defense attorney Jack Lassiter has cited prosecutorial delay in filing a motion recently to dismiss charges against Conte.
Clawson told attorneys for both sides Tuesday he was concerned about the delay.
