Texarkana, Texas police are investigating a possible hate crime.

Trey Jackson, who is black, told officers he was visiting the mall Tuesday afternoon when he got into an altercation with a group of white men, who he says were yelling racial slurs.

Jackson says he received a concussion from being hit by a baseball bat to the head.

"Out of no where a baseball bat comes out. I was hit two times in the head," said Jackson.

Meanwhile, one of the suspected assailants, 17-year old Alex Taylor, says it didn't happen that way.

Taylor alleges that Jackson called him names, based on his sexual preference, and tried to run him over with his car in the parking lot.

Jackson left his car on a sidewalk and then approached the men.

"He started walking to us looking suspicious with his hand in his pocket it looked like he had a gun, he pulled out something black, so I swung the bat," said Taylor.

Taylor was arrested Thursday evening at his home in Texarkana, Arkansas.

He is awaiting extradition to Texas.

Police say it will be up a judge to determine whether the incident is a hate crime.
