Caddo Commission no longer defendant in commissioner's lawsuit

The Caddo Commission and the parish's Industrial Development Board are no longer the defendants in the lawsuit filed by Commissioner Stephanie Lynch. Lynch, the District 7 commissioner, filed an amended petition that deletes the commission and IDB and names the Caddo Parish government as defendant. The amendment rendered commission attorney Dannye Malone's motion moot, but he still claims victory.

"The exception I filed today was to test the legal efficiency of Ms. Lynch's petition," Malone said. "In essence, the Caddo Commission was dismissed from the litigation today. That was the purpose of the exception."

Malone says the commission can't sue or be sued because it's a legislative body.

"It is as if an individual wanted to file suit against the State of Louisiana but, rather, filed suit against the state legislature," Malone said. "Which is rejected by both federal and state law."

Lynch also removed her commissioner title in the suit's filing and will continue filed as a regular citizen.

"It's proper legal form for me to file as an individual homeowner and taxpayer," Lynch said.

The commissioner says her suit is meant to ensure jobs are created at the former GM plant and not simply stop the parish from purchasing it. She believes others may join her in the suit.

"There may be some other homeowners, taxpayers and residents that may want to be joining this suit, as well," Lynch said. "I'm certainly getting a lot of phone calls, e-mails and support."

Malone says he'll now represent Caddo Parish in the lawsuit. The parish administrator is expected to be served by the end of the week. Judge Leon Emanuel set the next hearing in the suit on September 11th at 2 PM. Again, the Caddo Parish government as a whole is now the defendant in the suit.
