Justice For Justin: What's The Hold Up?

DESOTO PARISH, La. -

It was back on March 30th, 2010 when DeSoto Parish sheriff deputies found a little boy's body floating face-down in about a foot of water near some woods off U.S. I-71 in DeSoto Parish. The body belonged to 12-year-old Justin Bloxom. He was strangled to death.

Detectives say Bloxom was killed by 34-year-old cab driver and convicted sex offender Brian Douglas Horn. They say he lured Justin to his death by posing as a young girl through text messages. It's been more then three years since Bloxom's body was found. A memorial garden is growing at Justin's former middle school, and laws have been passed in his name but no justice has come for the family.

Desoto Parish District Attorney Richard Johnson says currently, "Horn has a showdown in court in February." He says some very unusual things have happened leading up to previous court dates.  

"First of all, there has been a change of attorneys on several occasions. We had at least two attorneys get on the case and leave for various reasons.  We are on our third attorney right now on the defense side," says Johnson.  He also says that when dealing with a capital murder trial (when they are seeking the death penalty) the defense is going to file motion after motion to take up time and keep their client alive.

For example, Horn's attorney filed a motion to have the case tried in another jurisdiction because of all the publicity.  A judged agreed to have the jury picked out of East Baton Rouge Parish.  Johnson says this is an example of a filed motion that will cause a delay in the trial.

The trial date for Brian Horn is February 1st, but Johnson says because of the jury situation, opening arguments probably won't happen until the second or third week of February.
